Collecting and Using Your Personal Data

Types of Data Collected

Personal Data

We collect personal data only when You choose to give it to Us, through one of three forms on this site: the Contact form, the Join the Club form, or the newsletter signup in the footer. Depending on which one You use, this may include:

  • Your first and last name
  • Your email address
  • Your phone number
  • Your company name
  • The content of Your message and which services interest You

The footer newsletter signup collects only Your email address. We don't ask for payment details, ID numbers, or any other sensitive personal data anywhere on this site.

Usage Data

Usage Data is collected automatically by Google Analytics when You browse the live site. It may include Your IP address, browser type and version, the pages You visit, and the time and date of Your visit. Google Analytics only runs on clubunbrick.co itself. It does not load on any staging or preview version of this site, so no Usage Data is collected there.

Tracking Technologies and Cookies

This site has no logins, shopping cart, or saved preferences, so it has nothing of its own to remember and sets no cookies. The only cookies You may encounter here are Google Analytics', and only on the live site. See Our Cookie Policy for the details.

Use of Your Personal Data

The Company uses Personal Data for the following purposes:

  • To respond to Your inquiry. Whatever You submit through the Contact or Join the Club form, someone on Our team reads it and replies.
  • To deliver the services You've engaged Us for, once You become a client.
  • To keep in touch: if You submit the Contact or Join the Club form, We add Your name and email to Our mailing list, run through Brevo, so We can follow up and send occasional updates about Our services. You can unsubscribe at any time; every email includes a link to do so. The footer newsletter signup only adds You to that same mailing list; it isn't shared anywhere else.
  • To route Your submission internally, so the right person on Our team sees it quickly and We can track it through to a reply.
  • To understand how the site is used: which pages get visited, how people find Us, so We can improve it, through Google Analytics as described above.
  • For business transfers: if Club Unbrick were ever acquired or merged, Personal Data may be among the assets transferred as part of that process.
  • To comply with the law, where We're required to.

We share Your personal data only in these situations:

  • With Service Providers who help Us run the Service, each of whom only receives what they need to do their job: Brevo (email delivery and Our mailing list), n8n (Our own workflow-automation system, which routes form submissions to Our team), Google Analytics (site traffic), and Hostinger (Our hosting provider).
  • For business transfers, as described above.
  • With Your consent, for any other purpose You've agreed to.

Retention of Your Personal Data

We keep the personal data You submit through Our forms for as long as it's useful for responding to You or, if You become a client, for delivering Our services, and no longer than that unless We're legally required to. If You're on Our mailing list, We keep Your details there until You unsubscribe or ask Us to remove them.

Usage Data collected by Google Analytics is retained according to Google's own retention settings for this property.

Transfer of Your Personal Data

Club Unbrick operates from Nairobi, Kenya, but the Service Providers We use (Brevo, Google Analytics, and Hostinger) may store or process data on servers outside Kenya as part of running their platforms. We only use providers that maintain their own data protection safeguards, and We take reasonable steps to keep Your data protected wherever it's processed.

Delete Your Personal Data

You can ask Us to delete any personal data We hold about You at any time by emailing info@clubunbrick.co. If You're on Our mailing list and just want the marketing emails to stop, the unsubscribe link at the bottom of any of those emails does that directly.

Please note, however, that We may need to retain certain information when We have a legal obligation or lawful basis to do so.

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law enforcement

Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Other legal requirements

The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:

  • Comply with a legal obligation
  • Protect and defend the rights or property of the Company
  • Prevent or investigate possible wrongdoing in connection with the Service
  • Protect the personal safety of Users of the Service or the public
  • Protect against legal liability

Security of Your Personal Data

The security of Your Personal Data matters to Us. Our forms run behind spam- and abuse-prevention checks before any submission reaches Our team or Our Service Providers, and no third-party credential is ever exposed to Your browser. That said, no method of transmission over the Internet is 100% secure, and We cannot guarantee its absolute security.

Your Data Protection Rights

Depending on where You are located, the rights above may be reinforced by data protection law specific to Your jurisdiction.

Kenya's Data Protection Act, 2019

Club Unbrick is based in Nairobi and processes personal data as a data controller under Kenya's Data Protection Act, 2019 (Cap. 411C). Under Section 26 of the Act, You have the right to:

  • Be informed of the use to which Your personal data will be put;
  • Access the personal data We hold about You;
  • Object to the processing of all or part of Your personal data;
  • Have false or misleading data about You corrected; and
  • Have false or misleading data about You deleted.

In line with Section 25 of the Act, We handle Your personal data lawfully, fairly and transparently; collect it only for the specific, legitimate purpose stated at collection; keep it accurate and no longer than necessary; and do not transfer it outside Kenya unless adequate safeguards are in place or You have consented.

If You believe We have not handled Your personal data in line with the Act, You have the right to lodge a complaint with the Office of the Data Protection Commissioner (ODPC).

GDPR — EEA & UK Visitors

If You are located in the European Economic Area or the United Kingdom, the General Data Protection Regulation (GDPR) gives You additional rights over Your personal data, including the right to:

  • Access the personal data We hold about You (Article 15);
  • Correct inaccurate or incomplete data (Article 16);
  • Request erasure of Your data, sometimes called the "right to be forgotten" (Article 17);
  • Restrict how We use Your data in certain circumstances (Article 18);
  • Receive Your data in a structured, machine-readable format (Article 20); and
  • Object to processing based on Our legitimate interests, including for direct marketing (Article 21).

To exercise any of these rights, contact Us using the details in Contact Us below. You also have the right to lodge a complaint with Your local data protection supervisory authority.

Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.

If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require Your parent's consent before We collect and use that information.

Links to Other Websites

Our Service may contain links to other websites that are not operated by Us. If You click on a third party link, You will be directed to that third party's site. We strongly advise You to review the Privacy Policy of every site You visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Changes to this Privacy Policy

We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page.

We will let You know via email and/or a prominent notice on Our Service, prior to the change becoming effective and update the "Last updated" date at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
